International migration and trends in its regulation

In this article, we seek to discern the global trends in policies and legal regimes applicable to international migration. We identify four fundamental trends: the duality of regimes, which insist on a sharp distinction between refugees and other migrants;
the fragmentation of regimes applicable to foreigners under a multiplicity of statutes that are difficult to navigate; the externalization of migration controls; and the fight against some (very numerically significant) migratory movements, often resorting to criminalization for this purpose.
