Abstract

A "Convenção sobre o acesso à informação, a participação do público no processo de decisão e o acesso à justiça em questões ambientais" (Convenção de Aarhus), consagra um direito fundamental de participação no processo decisório organizado por autoridades públicas. Este é um direito de todos, independentemente das fronteiras estaduais. A ausência de disposições específicas sobre a participação do público em atividades transfronteiriças levanta uma série de questões à s quais se pretende dar resposta.
