Straight Paths Toward Operational Urban Planning

Abstract

Having moved beyond the phase of preparing municipal land-use plans, particularly municipal master plans, and despite many of them currently undergoing revision, the fundamental issue in this specific area of urban planning law—namely, planning itself—is the effective implementation and execution of these instruments. Indeed, having well-crafted plans is of little use if the competent authorities are not provided with the mechanisms to ensure their operationalization. These mechanisms are, in turn, explicitly established and regulated in urban planning legislation, although some of its provisions still give rise to practical doubts regarding their application. This text aims precisely to highlight the fundamental importance of operational urban planning, seeking to clarify some of the uncertainties that have arisen in practice for the actors who are primarily involved in this field.
