Concrete Implementation and Effective Protection of the Natura 2000 Network – Some Issues

Nature conservation is one of the environmental areas in which the freedom of EU Member States to shape policy has been most drastically reduced due to the successive advances of Community Law. The EU Directives, together with their interpretation by the Community courts, have progressively imposed increasing obligations on the Member States.
First, there were strict zoning obligations based on purely scientific criteria, allowing no consideration of non-ecological factors.
Second, there were obligations of effective protection, incompatible with voluntary, consensual, or incentive-based instruments, requiring the exclusive use of legally binding instruments.
