Precautionary Measures in Planning

The precautionary measures associated with planning and their legal framework are established in Chapter IV of Decree-Law No. 380/99, of 22 September. This legislation preserves, as a precautionary measure, the already traditional concept of preventive measures in Portuguese law (Articles 107 to 116) and also introduces the innovative institution of suspension of license granting (Article 117). Considering the regime that the current urban planning legislation assigns to these instruments, the aim is to conduct an individualized analysis of each, in order to highlight their most significant and controversial aspects, determine their mutual influences, and present a comparative synthesis.
