The New EIA Regime: Assessment of Foreseeable Legislative Impacts

Since the adoption of a Community Directive on Environmental Impact Assessment (EIA) in 1997, it was known that the EIA regime in Portugal would have to change.
Three years later, the change arrived. On 3 May, Decree-Law no. 69/2000 repealed all existing legislation, corrected flaws in the previous legal regime, and introduced some innovations.
It is these innovations of the law that the authors analyse: some that place us at the forefront of the European field; others that expose us to serious risks of a repetition of the judicial incident which, in 1997, took Portugal to Luxembourg to stand in the dock before the Court of Justice...
