Established Jurisprudence:
The 15% percentage set forth in letter b) of paragraph 3 of Article 25 of the Expropriations Code, approved by Decree-Law No. 348/91 of 9 November—serving as a standardizing evaluation criterion—will lose its fixed nature, becoming flexible at the moment of its application, for each specific case, according to the assessment made of the “location and environmental quality” of the expropriated property, with the aim of achieving constitutionally fair compensation.
