Abstract

Several Autonomous Communities in Spain have enacted laws prohibiting the practice of hydraulic fracturing, or fracking. In response to this prohibition, the central State authorities reacted by slightly amending the basic regulations and lodging appeals of unconstitutionality. The social and political debate has thus been carried over into the legal sphere, which is where this study is situated, aiming to offer an initial approach to the constitutional issues that currently shape the discussion.
