This article aims to analyze environmental agreements in the Portuguese and Brazilian contexts. In light of the shortcomings of the command-and-control model and its instruments, it is imperative to seek new ways to implement the regulatory framework effectively. It is necessary to develop new schemes aligned with the key concepts of modern public law doctrines: flexibility, efficiency, transparency, responsibility, and openness to innovation. It is within this context, in the search for complementary approaches, that Environmental Agreements emerge.
