A brief analysis of the legal framework enshrined in Articles 8 and 11 of Law No. 50/2006 of 29 August

The core purpose of this paper is to analyse the regime of liability for environmental administrative offences as set out in Law No. 50/2006 of 29 August, commonly referred to as the Framework Law on Environmental Administrative Offences. Specifically, the discussion will address two sets of issues: (i) the criteria by which liability for environmental administrative offences is assessed in respect of both legal persons and natural persons (Article 8); and (ii) how the rule on joint and several liability set out therein (Article 11) should be interpreted.
