The “instrumentalisation” of natural monopolies against pathways towards energy efficiency measures

The aim of this article is to analyse some of the various issues raised by the current legal framework for low-voltage electricity distribution, particularly with regard to the management of public lighting. Essentially, the author intends to challenge the traditional argument that, based on the “theory” of “natural monopolies,” would render the low-voltage electricity distribution concession indivisible, thus preventing the granting authorities from adopting legal and management measures aimed at improving energy efficiency.
