Legal Environmental Principles and Forest Protection: Deliberately Vague Considerations

Abstract

The forest is a resource divided between ecology and the economy. This dual nature is reflected in the set of principles stated in Article 3 of Law 33/96 of 17 August (Framework Law on Forest Policy), which must inevitably be complemented by other principles derived from the Constitution and the Framework Law on the Environment, specifically the principles of prevention and accountability.

In a future Forest Code, greater linguistic conciseness and terminological harmonization between the Framework Law on Forest Policy and the Framework Law on the Environment should be considered.
