Change of Use of Real Estate

The issue of changing the use of buildings or their units assumes significant urban planning importance, particularly from the moment it was recognized that urban law should also address the distribution of human functions across the territory, outlining which uses are mandatory, permissible, or prohibited within the reference area. In Italian law, legislative and jurisprudential responses have followed one another regarding the definition of which changes in property use require prior administrative control. Throughout this article, the author describes the evolution and critical aspects of the regulatory framework on this subject, while also formulating some proposals for determining its scope.
