Community Framework for State Aid in Favor of the Environment

The imperfect functioning of the market requires the intervention of public authorities in actively promoting sustainable development, potentially restricting the free play of supply and demand. The ECAEFA aims to ensure a balance between the demands imposed by environmental policy and those arising from competition policy, reconciling the criteria used by the European Commission in assessing the various types of state aid in favor of the environment with the regime set out in Article 87 of the EC Treaty. These aids are grouped into three main categories: investment aid, horizontal measures, and operating aid, each of which is subject to specific requirements.
