Abstract

O artigo 102º do RJUE postula o dever de a Administração Autárquica repor a legalidade urbanística. A demolição de obra ilegal por falta de licença de construção, ou por ancorar em licenciamento ilegal têm como célula primordial a impossibilidade de licenciamento (ou comunicação prévia) ou de ajustamento da mesma às normas urbanísticas legais e regulamentares.
