Regarding the legal framework governing the procedures designed for the assessment of the environmental impact of certain actions and of specific plans or projects, and the procedural legitimacy established for such procedures, we revisit the reflective examination of the constitutive dimensions of a “communicatively just” decision and, predominantly, the contributions that the principle of good administration, enshrined in Article 41 of the Charter of Fundamental Rights of the European Union (CFREU), may entail in ensuring an environmentally responsible decision.
