Abstract

In this article, the authors aim to provide an assessment of the current legal framework applicable to the establishment of commercial units. This framework, in addition to duly considering the urban, economic, and social interests underlying the issue, unfolds across multiple levels of regulation, which are not always fully consistent with one another.

It is from this “multipolar” regulatory framework—subjected to a critical analysis by the authors—that some proposals are formulated, aiming to contribute to the creation of a genuine “commercial urban planning policy.”
