Abstract

Subdivision operations are undoubtedly among the most important urban planning activities, governed by a legal framework that imposes a set of specific obligations.

With Decree-Law No. 555/99 of 16 December, later amended by Decree-Law No. 177/99, the legislator undertook a revision of this legal figure for the purposes of the regime established therein. These legal instruments also aimed to address the frequent problem of using other legal structures to disguise true subdivision operations (and thereby avoid the heavy obligations to which they are subject), the most typical case being condominium ownership over groups of buildings.

The need to properly define the scope of each of these legal structures and the advantages of choosing one over the other is the focus of this article, which thus serves to revisit a topic previously discussed in the pages of this journal.
